Last Minute Anti-Business Provisions of HB 2359

ORA lobbyist Benny Vanatta reports that on the final day of the legislative session in a last minute decision, the House and Senate passed and sent to the Governor House Bill 2359.  This bill was part of the package of bills to balance the 2010-2011 budget which begins July 1, 2010. The Governor is expected to sign the bill into law at any time.  In addition to other parts of the bill, we wanted to make you aware of two provisions that may affect you.

Currently, you are allowed to deduct 2.25%, up to a maximum of $3,300, of the amount you remit to the Tax Commission in sales taxes you collect as a benefit of collecting these taxes for the state.  A new section of this law reduces the deduction to 1%, up to a maximum of $2,500.

Another section of the law increases the license fee for vending machines, that take more than 25 cents to operate, from $50/year to $150/ year.

Benny reports that the specific language of HB 2359 was only made known to the business community on the last day with no chance to generate support to kill those provisions of the bill.  Although the ORA had a mostly successful session, it was disappointing to have HB 2359 passed on the last day with no chance of trying to change the bill to be more favorable to our members.  If you have questions, or need more information, please call Benny at 918-625-5132 or Jim Hopper at 405-942-8181.
